Hi wonder if anyone has any idea of the following. Just purchased a fortnight ago from a dealer a Black 850R Estate with Auto Box 133K and FSH. Have had some niggly problems which seem to have been cured by changing some split hoses around engine, However just been out to shops and to fill it up and have had total G'Box failure. Managed to crawl home in 'D'. select 'R' on drive nothing, give it some revs and its jumps backwards. Selecting 'L', '3' or 'D' theres nowt. Anyone got any ideas still under 3 month warantee but only upto £500. Have I been sold the preverbial LEMONNNN.

The law says you are covered for the full cost of repair as any vehicle sold over £500 comes with a full warrenty.
Go back to the dealer and quote your rights, otherwise, go to citizens advice and get them to give you the lowdown.
Goods have to be in a resonable state and fit for purpose etc...
It sounds like a brake band issue, it could cost around £500 - £1500 to put right at a gearbox specialist.

Got a 3 month £500 waranty not even live yet. No expert but brake band at 500-1500 sounds disastrous. Having no luck with motor after 150 mile Lambda light on diagnosed as MAF sensor. Light went out. engine and car look immac used to drive a dream. Cannot believe G'box would go many thanks for the info

Yes, Sale Of Goods Act covers all car sales, and ....

Key Facts of Sale of goods Act:

• Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).

• Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.

• Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.

I used this on the muppet i bought my car off, took him to the small claims court and won....is very quick to do too.

First write a letter outlining the sale of goods act, use inernet to get correct words. State that the car is not up to the qualitiy specified in the act. You can either refuse the goods OR get a full repair.

See where that takes you and inform trading standards as well. Next is then small claims court, which is very very simple, process again listed on a government website....

I received all the work done to my car from doing this...

Cheers guys, Car looked and drove fantastically been after one for ages. Fully stamped up FSH with shed load of receipts even new volvo turbo fitted 3k ago. Could not believe luck when engine light went on, so far been in a garage 3 days had a diagnostics test only done about 350 mile in it and it was 140 trip to get it and now looks like Gearbox gone. Dealer is a muppet excuse after excuse but will heed advice cheers Col.

Hi thanks for the info, does really sound like i've bought a LEMON. Well hacked off as it now seems to need MAF sensor 2 other hoses replaced a knock from the top suspension mount and now big problems with Gearbox. All faults reported after a whole 9 days of having the car and literall a coule of hundred miles driven. Dealer had not even sent of waranty paperwork. Told me he'll cover the cost of sensor boy he's in for a shock when i tell him about gearbox. Keeps telling me well you wanted car as you drove 140 mile to buy it and what can you expect for a 10 yr old car with 133k. Thought i might have made it to next service not 14 days a Kaputt. Just a quicky adrian did you have to pay for all repairs then claim money back and can I get them done at a garage i trust or does he get to chose? Like i say not very practical car doesn't drive and he's 140 mile away

garage did the initial repairs, then it broke down again, so it went to the nearest volvo garage, the garage called teh people i bought it off, i paid for it, then took them to court.....

Holy smoke that is going to cast an absolute fortune. Been quoted £211 just for the sensor, full top suspension mount £243 couple of hoses and you reckon between £500 to £1500 for Gearbox. Might as well start building the gallows now. Could the Gearbox prob be anything else or is it normally terminal?

If that is the case, then get the peeps you bought it off to do the work, get the bills for the work done as proof of doing it and then smile as you have a newer car that when you started.....

OR refuse the car as its crap and get a full refund...as per the Sale of Goods Act...you are entitled to do that too...and then the garage you bought it off has to then do the work anyway.....

Look on the bright side: It'll be worth more wit ha new gearbox.

The reason people buy cars from dealers instead of Private is they get warranties which is in essence a guarentee that the car is good. You pay more from a dealer and this is why. If they didnt do it they would never sell anything.
Either they bodged it to work on the test drive or you are extremely unlucky as the box should be good for a lot more than 140k
You have rights, use them and do it sooner rather than later. Yeah, its a pain in the ass but the car will be awesome after.

£243 seems a lot to me for a topmount. My V70 cost me about £100 for parts and I did it myself in an hour

Stuck between a rock and a hard place and I already know the dealer is going to be hardball. Not sure what the car would be worth with all snags gone. Like I say Diamond Black 850R 'P' Aug 86 FSH 133K new turbo 3K ago added to that new gearbox what are we talking. Totally mint bar a 5 mm split in the drivers r/h edde of seat. Is it worth it all the hassle or is it time for full refund and start looking again. Paid smidge over 3k

Well, you do your rescearch on the Sale of Goods Act and you too can play equally hardball....thats what it is there for and the dealers rely on you not using it or knowing about your own rights...read up on it.....just type it in google.....

Cheers Adrian, thanks for the link. Had checked out the DTI for sales of Goods Act so ready with both barrels tomorrow when I call. Still debating full refund or fix can't trust him plus he's 140 mile away. Trusted garage less than a mile away but guess got to get crook to agree to rectification and cover costs. What do you think she'll be worth in your opinion when 100% straight ? Could the G'box prob be anything simple. Just been out to it and its stationary in all gears and modes

Really need to get the gearbox codes read, only a few garages can do this, not the same as ECU fault codes, the gearbox has its own ones........that should point you in the direction of the fault....well mine has, not sure about yours looking at your car year.......anyone else know

Anyway, not sure on values, use parkers.co.uk, though with new bits car will be peachy, and then you have to go through the same process wqth another vendor.....so .....cant really say one way or another....i kept at mine till all work was done and then found a decent garage.

Cheers mate, veering towards keeping it although think might have to sell a well worn kidney to fund the fixes til the crook pays up. Just crossing everything that its a simple one. been through all the threads and it does seem unusual that a 2 owner 130K FSH gearbox gone then again i do have JONAH as a middle name

Parkers wont value anything on-line less than 97/98 unless you pay.

I found a site called Wisebuyers (.co.uk I think) who went back to 95.
I used them for a quote on F-Bs Gul (I had to mail them as they wouldnt quote on his mileage) and they came back with £3k!!

Rarely you see these cars on the market for less than £3k. They seem to fetch between £3 to £4 K privately probably closer to £3k although a lot of optimistic sellers seem to value closer to £5k. My gut feeling is you paid a fairly low price for this type of car from a dealer. Good luck with your plight I hope you resolve it satisfactorily.

Cheers Baj, will try the link. Car seems to be riddled with probs but tried to get one for months and this one looks a dream. Although sat stationary flat out a 0mph on the drive. Not sure whether looking for another or biting the bullet and getting this one straight. Think the bullet will be easier but cheaper in long run and like you guys say worth a bit more in the end

Many thanks for all the info guys. Spoke to the dealer this morning and he offered me a full refund on the car. Told him that I was more interested in a serviceable car. After quoting Sales of Good Act, i am now taking car to a trusted garage for full repair at no cost to me. Dandy. As for gearbox the oil is definately not cherry red more like coke brown no wonder its got problems. Hopefully in a day or two the car will be back running like a dream. Once again thanks for all the posts.

Ask for his intentions and scope of work in writing prior to instructing garage to commence work.
